READ THE FOLLOWING TERMS AND CONDITIONS BEFORE USING MEEBOOK.

1. Your acceptance

Thank you for choosing to use Meebook. Meebook respects applicable copyright law and expects its users to do the same, in accordance with the Danish Copyright Act of 2008. These terms of agreement (“Terms”) govern your access to and use of the Meebook website. Please read these Terms carefully before you begin using the Services.

By using the Services, you agree to and are bound by the Terms of this agreement. If you use the Services on behalf of an organisation, you agree to these Terms on behalf of the entire organisation and you warrant that you have the authority to bind the organisation to these Terms. In that case, “you” and “your” refer to your organisation.

You may only use Meebook in accordance with these Terms. Meebook may at any time remove content from the website meebook.com based on a professional and legal assessment.

By using the website meebook.com you indicate your agreement with (1) these terms and conditions found at https://meebook.org/terms-conditions. If you do not agree with all of these Terms, you may not use the Meebook website.

Although we will of course attempt to notify you when there are major changes to these Terms and Conditions, you should regularly review the most up-to-date version at https://meebook.org/terms-conditions. Meebook may, at its own discretion, change or revise these terms, conditions and policies at any time, and you agree to be bound by such changes and revisions.

All IP rights to the Meebook LMS are owned by Meebook ApS and may not be copied or used without the prior approval of Meebook.

2. The Meebook website

A. These Terms of Service apply to all users of the Meebook website.

B. Use of AI generated images: Some images on this website are AI generated and are used solely for visual presentation. The persons shown in these images are not real. The images are not connected to any actual individuals, and they contain no personal data.

If you have any questions regarding the use of AI generated images, you are welcome to contact us.

3. Meebook accounts

A. In order to access the features on the website, you must have a Meebook account. You may never use another party’s account without permission.

B. You are not allowed to create a Meebook account if you are not employed at an institution that has purchased a subscription to Meebook. If you are in doubt, please contact the administration at your workplace before creating an account.

C. You are not allowed to create a Meebook account for commercial purposes, such as copying Meebook as a product or copying Meebook’s features or workflows.

D. When creating an account, you must provide correct and complete information.

E. You are solely legally and financially responsible for all activity carried out on your account. You must use a secure password for your account. You must contact Meebook immediately if you suspect any breach of security or unauthorised use of your account.

F. Although Meebook cannot be held liable for your loss as a result of any unauthorised use of your account, you may be held liable for losses of Meebook or other parties due to such unauthorised use.

G. Only one account per person is allowed. Meebook reserves the right to close an account if there is suspicion of repeated account creation by the same person.

4. General use of the website – permissions and restrictions

Meebook hereby grants you permission to access and use the website meebook.com as set forth in these Terms and Conditions, provided that:

A. You agree not to distribute any part of the website in any medium without Meebook’s prior written permission.

B. You agree not to alter or modify any part of the website meebook.com.

C. You agree not to use the website for any commercial use without prior written permission from Meebook. Prohibited commercial uses include one or more of the following actions taken without Meebook’s express approval:

  • Sale of access to the website

  • Sale of content/material generated in Meebook

D. You agree not to use or launch any automated system, including without limitation “robots”, “spiders” or “offline readers”, that accesses the website in a way that sends more requests to Meebook’s servers in a given period than a human can reasonably produce in the same period using a conventional online web browser. You agree not to collect or harvest any personally identifiable information, including account names, from the website, or to use the communication systems provided by the website (for example comments, e-mail) for any commercial advertising purpose. You agree not to solicit, for commercial purposes, any users of the website with respect to their user submissions.

5. Material on meebook.com

A. By using the website meebook.com you provide us with information and files that you upload to Meebook’s servers. You hold the rights to distribute this material subject to applicable copyright law and compliance with the applicable Copy-Dan rules. The material is not owned by Meebook but by the copyright holders of the material in question.

B. Material distributed through the website meebook.com may be used solely for teaching purposes, unless otherwise agreed with Meebook.

C. It is not permitted to distribute pornography, obscene or defamatory material, or material of excessive length. At all times it is Meebook’s assessment that determines whether the material complies with normal education-related use.

D. Meebook may at any time remove material uploaded by the user if the material does not comply with the conditions of this agreement. The user will be notified hereof, although Meebook cannot be required to provide an explanation for the removal of material.

E. If you are notified by either Meebook or a third party that a course (i) developed by you, (ii) obtained in ShareIT, or (iii) shared with you by another user contains material that infringes applicable copyright law, you must immediately delete the material from all accessible courses. You (the user) and not Meebook are responsible for doing this.

F. If you choose to use streaming content from other web services (for example YouTube, Vimeo or SoundCloud), it is your responsibility to ensure that this content complies with all laws and regulations relating to copyright. Meebook cannot be held responsible for the distribution of illegal material through these web services.

6. When sharing courses with other teachers and pupils, you accept that:

  1. The shared course does not contain material that infringes applicable Danish copyright legislation.

  2. The shared course, where it contains scanned material, complies with the applicable rules concerning the scanning of physical materials, cf.

  3. Any colleague who receives the shared course, where it contains scanned material, is employed at an institution that has entered into an agreement with COPY-DAN regarding the scanning of materials.

  4. The material contained in the shared course complies with the general terms and conditions governing the use of the Meebook service.

  5. The course is shared under the Creative Commons licence Attribution – Non-Commercial – ShareAlike (by-nc-sa).

7. Termination of the policy

A. Meebook will terminate a user’s access to the website if the user does not behave appropriately and if repeated misuse of copyright or user content occurs.

B. Meebook reserves the right to determine whether content or a user’s behaviour is appropriate and in accordance with these Terms and Conditions in relation to infringements other than copyright infringement, such as but not limited to pornography, obscene or defamatory material, or content of excessive length. Meebook may remove such users at any time without prior notice and at its own discretion.

8. Digital Millennium Copyright Act

A. If you hold the copyright to material and believe that a user on Meebook is infringing your or others’ copyright, you may submit a notice under the Digital Millennium Copyright Act.

A physical or electronic signature is required from a person authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

9. Disclaimer of warranty

You agree that your use of the Meebook website is at your sole risk. Meebook makes no warranties or representations regarding the accuracy or completeness of this website’s content or the content of any sites linked to this site, and assumes no liability for any:

  • errors or inaccuracies in the content,

  • personal injury or property damage of any nature whatsoever resulting from your access to and use of our website,

  • any unauthorised access to or use of our secure servers and/or any and all personal information and/or financial information stored therein,

  • any interruption or cessation of transmission to or from our website,

  • any bugs, viruses, Trojan horses or the like which may be transmitted to or through our website by any third party, and/or

  • any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, e-mailed, accessed via ID, transmitted or otherwise made available via the Meebook website.

10. Limitation of liability

Under no circumstances shall Meebook, its directors, employees or agents be liable for any direct, indirect, incidental, special, punitive or consequential damages arising from:

(I) errors, mistakes or inaccuracies in content,
(II) personal injury or property damage of any nature whatsoever resulting from your access to and use of our website,
(III) any unauthorised access to or use of our secure servers and/or any and all personal and/or financial information stored therein,
(IV) any interruption or cessation of transmission to or from our website,
(V) any bugs, viruses, Trojan horses or the like which may be transmitted to or through our website by any third party, and/or
(VI) any errors or omissions in any content or any loss or damage of any kind incurred as a result of your use of any content posted, e-mailed, accessed via ID, transmitted or otherwise made available through the Meebook website, whether based on warranty, contract, tort or any other legal theory, and whether or not the company has been advised of the possibility of such damages.

The above limitation of liability shall apply to the fullest extent permitted by law in the relevant jurisdiction.

The website is controlled and offered by Meebook from its facilities in Denmark. Meebook makes no representations that Meebook is appropriate or available for use in other locations. Those who access or use the Meebook website from other jurisdictions do so at their own initiative and are responsible for compliance with local law.

11. Indemnification

You agree to defend, indemnify and hold harmless Meebook, its parent company Meebook ApS, directors, employees and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt and expenses (including but not limited to attorneys’ fees) arising from:

(i) your use of and access to the Meebook website,
(ii) your breach of any term of these Terms of Service,
(iii) your violation of any third party right, including any copyright, property or privacy right, or
(iv) any claim that your user content has caused damage to a third party.

12. Ability to accept the Terms of Service for meebook.com

You confirm that you are over 18 years of age and employed at an educational institution in Denmark.

13. Terms for sharing courses in Meebook in ShareIT and when sharing between teachers

When you choose to publish a course in Meebook ShareIT or share courses in other ways and thereby grant access to your course to other teachers, you automatically accept the terms described below.

If you choose to use courses shared by others in ShareIT, you likewise accept the terms described below.

A. The general conditions for use of the Meebook website are complied with.

B. The course published in ShareIT does not contain material that is protected by applicable copyright or licences that do not entitle you to further distribute and/or share the material. When you use courses either downloaded from ShareIT or shared with you in another way, the course is covered by the general rules for sharing in Meebook (which can be read here). As a user you are responsible for ensuring that the course does not contain material that infringes third party copyrights before you distribute it further.

C. Courses that you share with teachers at your own institution must not contain material that is protected by applicable copyright which does not entitle you to further distribute the material within the institution.

D. Courses that you share with teachers in your municipality must not contain material that is protected by applicable copyright which does not entitle you to further distribute the material within the municipality.

E. If copyright or other rights are infringed in courses published by you in ShareIT, you are legally and financially responsible.

F. The course is published under the Creative Commons licence Attribution – Non-Commercial – ShareAlike (by-nc-sa):

(i) This licence allows others to adapt, including change and adjust, your work,
(ii) for non-commercial purposes,
(iii) provided that they credit the work in the manner specified by you,
(iv) others may download and share your course in Meebook, translate, modify and create new works based on your work, and
(v) all new works based on your work must be licensed under the same licence, which means that any adaptation will also remain non-commercial,
(vi) courses may only be shared under another licence type in ShareIT by means of a written agreement between Meebook and the rightsholder.

G. If the course contains scanned material, this must not infringe the applicable rules regarding the scanning of physical materials, cf.

H. When you share courses in ShareIT, you as the author may be recommended to other users in Meebook.

14. Pupil plans

Please ensure that you only write information that is factually relevant to the assessment of the pupil. The information must be linked to a learning objective.

Avoid writing sensitive personal data about the pupil.

Please remember that teachers with whom you have shared a year plan also have access to the pupil plans. When you activate year plans and pupil plans, parents, pupils and school management can also see the pupil plan.

15. Google integration terms

Access to Google data: From Meebook you can access your Google Drive via the Google API.

Storage of files and user data: All files from Google Drive that are integrated into Meebook courses or pupil submissions remain on Google Drive, and no files are stored locally by Meebook. Meebook only links to files in Google Drive.

Rights: The rights that you as a teacher give other users in Google Drive to your files are the same rights that are applied in Meebook. When pupils submit assignments with files from Google Drive, editing rights to the files are transferred to the teacher or teachers who published the course. If the assignment is reopened, editing rights are transferred back to the pupil.

Sharing files from Google Drive: If you share courses with colleagues or pupils that contain files from Google Drive, you grant these users access to view these files. If you have given these users editing rights in Google Drive, they will also be able to edit the files. Meebook does not share user data such as Google user names between users of Meebook.

Access and user data: In order to integrate files from Google Drive, you must, the first time you use Google Drive in Meebook, approve that Meebook may access your file list. Meebook stores your user name and e-mail address for the integration between Meebook and Google.

Use of user data: Meebook only uses user data for the integration between Meebook and Google Drive and may not use the data in other contexts without the user’s approval.

16. Personal data

When you use Meebook you must be aware of which information you enter. It is your responsibility not to enter sensitive personal data such as information about well-being, health or religion in the platform.

If you are in doubt about what constitutes sensitive personal data, you must contact your school / management / municipal administration.
